Path brush tool will occasionally fill in the unselected shape below it when set to "create new"

I'm having a hard time understanding why the path brush tool will occasionally fill in the unselected shape below it when I have it set to "create new".

@Boldline I think the switching away from the tool (command+) causes this, it forgets the "Create New" mode (even if that is selected).
I will try to fix this ASAP.
